Baby Equipment Hire – Basic Terms and Conditions

1. Definitions

  • “Company”, “we”, “us” or “our” means [Company Name].

  • “Customer”, “you” or “your” means the person making the booking.

  • “Equipment” means any baby car seat, pram, pushchair, buggy, accessory or related item hired from us.

  • “Hire Period” means the period stated in the booking confirmation.

2. Booking and payment

  1. A booking is confirmed only when we have received the required payment or deposit and issued a booking confirmation.

  2. The person making the booking must be at least 18 years old and have authority to enter into this agreement.

  3. Full payment is due [before collection/delivery/on the date of booking].

  4. Prices include only the equipment and services specifically stated in the booking confirmation.

  5. Delivery, collection, fitting or additional accessories may incur extra charges.

3. Hire period

  1. Equipment must be returned by the date and time stated in the booking confirmation.

  2. Late returns may incur a charge of [amount] per day or part-day.

  3. If equipment is not returned, we may charge the replacement cost in addition to any outstanding hire charges.

  4. The hire period may be extended only with our prior agreement.

4. Cancellation and refunds

  1. You may cancel your booking by contacting us in writing.

  2. Cancellation must be a minimum of 24 hours prior to hire period to receive a full refund

  3. Any refund is subject to the terms stated above and may exclude delivery or administration charges.

  4. If we need to cancel because the equipment is unavailable or unsuitable, we will offer alternative equipment where possible or provide a refund of the affected booking.

5. Security deposit

  1. A refundable security deposit of $100 may be required before the equipment is released.

  2. The deposit may be used to cover:

    • Damage beyond reasonable wear and tear;

    • Loss or non-return of equipment;

    • Late return charges;

    • Cleaning charges;

    • Missing parts or accessories; or

    • Any other amount owed under these terms.

  3. Any remaining balance will normally be refunded within 2 business days after the equipment is returned and inspected.

6. Condition and inspection

  1. We will provide equipment that is, to the best of our knowledge, clean, functional and fit for its intended purpose at the start of the Hire Period.

  2. You must inspect the equipment upon delivery or collection and notify us immediately of any apparent damage, missing parts or fault.

  3. If no issue is reported at the start of the Hire Period, the equipment will be treated as having been accepted in satisfactory condition, except for faults that could not reasonably have been identified at that time.

  4. You must not use equipment that appears damaged or unsafe. Contact us immediately for instructions.

7. Safe use of car seats

  1. The customer is responsible for ensuring that the car seat is suitable for:

    • The child’s age, height and weight;

    • The vehicle in which it will be used; and

    • The applicable legal and safety requirements.

  2. The customer is responsible for installing and using the car seat correctly, unless a professional fitting service has been expressly booked and provided by us.

  3. You must follow the manufacturer’s instructions at all times.

  4. You must not modify, repair, disassemble or alter the car seat.

  5. A car seat must not be used after any accident, impact or event that may have affected its safety. You must notify us immediately if this occurs.

  6. Car seats must not be used for purposes for which they were not designed, including as a substitute for a cot or unsupervised sleeping device.

  7. We may refuse to hire or release a car seat if we reasonably believe it is unsuitable for the child or vehicle.

8. Safe use of prams and pushchairs

  1. You must use the pram or pushchair in accordance with the manufacturer’s instructions.

  2. Children must be appropriately secured using the fitted harness or restraint system.

  3. The pram or pushchair must not be overloaded or used to carry more than the manufacturer’s stated capacity.

  4. You must apply the brakes when the pram or pushchair is stationary.

  5. You must not leave a child unattended in the equipment.

  6. You must not hang excessive weight from handles or use the equipment in a way that may cause it to tip over.

  7. The equipment must not be used for purposes other than transporting a child.

9. Customer responsibilities

During the Hire Period, you must:

  • Take reasonable care of the equipment;

  • Keep the equipment clean and dry where reasonably possible;

  • Use it only for its intended purpose;

  • Keep it secure when not in use;

  • Not lend, sell, sub-hire or transfer it to another person;

  • Not remove labels, safety notices or identification marks;

  • Report loss, damage, theft or faults immediately; and

  • Return all equipment, parts and accessories at the agreed time.

10. Cleaning and damage

  1. Normal use and minor signs of use are permitted.

  2. You may be charged for excessive dirt, stains, food contamination, pet hair, smoke odour, mould or other cleaning that goes beyond normal use.

  3. You are responsible for the cost of repairing or replacing equipment damaged while in your possession, except where the damage is due to normal wear and tear or an existing fault.

  4. We will notify you of any proposed deduction from the security deposit and, where reasonably possible, provide details of the damage or charge.

11. Loss, theft and replacement

  1. You are responsible for the equipment from the time of collection or delivery until it is returned to us.

  2. If equipment is lost, stolen or not returned, you may be charged its full replacement cost.

  3. You must report theft to the police and provide us with the relevant crime reference number where applicable.

  4. Returning different equipment or incomplete equipment may be treated as non-return.

12. Delivery and collection

  1. You must provide accurate delivery and collection details and ensure that someone is available at the agreed time.

  2. Additional charges may apply for failed delivery or collection caused by incorrect information, lack of access or nobody being present.

  3. Delivery times are estimates unless a specific time has been expressly agreed.

  4. We may require identification and proof of booking before releasing equipment.

13. Liability

  1. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

  2. Subject to that, we are not responsible for loss or damage caused by:

    • Incorrect installation or use;

    • Failure to follow manufacturer instructions;

    • Use of unsuitable equipment for a child or vehicle;

    • Unauthorised alteration or repair;

    • Failure to report a fault promptly; or

    • Events outside our reasonable control.

  3. We are not responsible for indirect or consequential loss, including missed travel, accommodation or other costs, except where required by law.

  4. Our liability will not be limited where the loss results from our fraud, deliberate misconduct or negligence causing personal injury or death.

14. Faulty or unsuitable equipment

  1. If equipment develops a fault during the Hire Period, stop using it and contact us immediately.

  2. Where reasonably possible, we may provide a replacement item, repair, alternative arrangement or refund for the affected period.

  3. We may inspect or test equipment before deciding the appropriate remedy.

15. Personal information

  1. We will process your personal information in accordance with our privacy policy and applicable data-protection laws.

  2. We may use your information to process bookings, arrange delivery and collection, take payment, manage deposits and communicate with you about the hire.

16. Changes to these terms

We may update these terms from time to time. The terms applying to your booking will be those provided or made available when your booking is confirmed.

17. Governing law

These terms are governed by the laws of [country/state]. Any disputes will be subject to the courts of [country/state], unless applicable law provides otherwise.

18. Customer acceptance

By making a booking, paying for the hire or accepting delivery or collection of the equipment, you confirm that you have read, understood and agreed to these terms and conditions.
